INTELLECTUAL PROPERTY POLICY

The Platform is firmly committed to respecting the intellectual property rights of third parties and requires its users to do the same. Our Platform's Terms and Conditions of Use expressly prohibit posting, sharing or transmitting any content that infringes or violates copyrights, registered trademarks, or any other intellectual property right belonging to third parties.
Copyright grants legal protection to the creators of original works, including but not limited to musical, visual, and literary works. The Platform prohibits the use of content that infringes the copyrights of third parties, except where permitted by legal exceptions.
The Platform will adopt measures such as the removal of infringing content and, in cases of repeat infringement, the suspension or cancellation of accounts. A mechanism is provided so that rights holders may report infringements, with a warning about the legal consequences of making false accusations, through our User Guide for the management of complaints.
Users are granted a limited, non-exclusive, non-sublicensable (except to authorized service providers) and non-transferable license to access and use the Platform solely in accordance with the Terms and Conditions of Use and other applicable policies, with no rights of sale, transfer or sublicensing.
The Platform fully acknowledges and respects the intellectual property rights and image rights of the content that users post in the community features. By posting messages, comments or reactions in those features (such as the "La afición" match chat), the user retains all of their intellectual property rights and image rights over such content. Under no circumstances will the Platform claim ownership, copyright, image rights or any other intellectual property right over the content posted by users. However, by using the Platform, the user grants the Platform a limited, revocable, non-exclusive and royalty-free license to host, display and distribute such content within the Platform, exclusively for the purpose of operating, promoting and improving our services. This license does not allow the Platform to edit, commercially exploit, sell or assign the content to third parties without the explicit consent of the rights holder.
Users must avoid infringing the rights of third parties and obtain all necessary rights for the content they share. This includes establishing appropriate procedures to handle infringement notices and complying with the laws relevant to content provided by users or third parties.
Trademark infringement is prohibited on the Platform.
Complaints Process regarding Intellectual Property Rights
Objective:
To establish a clear and efficient procedure for handling complaints related to the violation of intellectual property rights in the content posted by users on our platform.
Process Steps:
1. Submission of the Complaint
- Claimant: Any person or entity who believes that their intellectual property has been infringed may submit a complaint.
- Complaint Form: The claimant must complete a complaint form available on the platform, providing all necessary information:
- Identification of the infringing content (link or detailed description).
- Description of the material protected by intellectual property rights.
- Proof of ownership of the intellectual property rights.
- Contact details of the claimant.
2. Reception and Registration
- Moderation Team: The moderation team receives the complaint and records the details in a complaints-management system.
- Acknowledgement of Receipt: An acknowledgement of receipt is sent to the claimant, indicating that their complaint is being processed.
3. Initial Review
- Data Verification: The moderation team verifies the information provided to ensure that the complaint is complete and valid.
- Preliminary Assessment: A preliminary assessment is carried out to determine whether the complaint has apparent merit.
4. Notification to the User
- Infringing User: If the complaint has merit, the user who posted the infringing content is notified.
- Complaint Details: The notification includes details of the complaint and asks the user for a response or evidence that no intellectual property right has been infringed.
5. Response Assessment
- User Response: The user has a set period, 7 business days, to respond to the notification.
- Review of Evidence: The moderation team reviews any evidence or response provided by the user.
6. Final Determination
- Decision: Based on the review of the complaint and the user's response, the moderation team makes a decision:
- Infringing Content: If the content is determined to infringe intellectual property rights, it is removed.
- No Infringement: If no infringement is found, the content remains on the platform.
- Notification of Decision: The claimant and the user are notified of the final decision and the actions taken.
Corrective and Preventive Actions
- Content Removal: The infringing content is removed from the platform.
- Sanctions: In cases of repeated infringement, additional sanctions may be imposed on the user, such as account suspensions or restrictions.
- Policy Improvements: The platform's policies are reviewed and improved to prevent future infringements.
Record-Keeping and Documentation
- Complaints Record: All complaints and decisions are recorded and documented for future reference and audits.
- Periodic Reports: Periodic reports are generated on the status and nature of the complaints received.
Third-party advertising creatives
(Section specific to Feeberse Score, added on top of the base owing to its advertising-funded model.)
The advertising creatives displayed through the ad server (including those of betting operators) are the property of their respective advertisers or rights holders. Feeberse Score acts as a medium and is not liable for the content of such creatives beyond its role as publisher. The intellectual property complaints process described in this Policy extends to advertising creatives where applicable.
Sports data and competition trademarks
The sports data, statistics and feeds displayed on Feeberse Score come from external providers specialized in sports data and are protected by the intellectual property rights of their holders; they are offered for informational purposes and may not be extracted, reused or commercially exploited by users. The trademarks, badges and names of leagues, competitions and clubs belong to their respective holders and are used for merely informational and nominative purposes, without implying any association or sponsorship.
